How to Use the Calculator
To estimate the amount of late filing and late payment penalty and interest due on your late return and late payment:
- Select the tax type for which the return is due.
- Select/enter the appropriate due date of the return and payment.
- If extensions of time to file were granted enter the extended due date of your return.
- Enter the estimated date the return and payment will be received by the Department.
- Enter the amount of tax due. Enter a whole dollar amount only.
- Click the calculate button.
Important Information
This calculator only computes late filing/late payment penalties and interest due when the balance of tax due is sent with the late filed return. If other late payments were made, the calculator cannot properly calculate the balance of penalty and interest currently due. If you require assistance, please contact us.
Late filing/late payment penalties and interest accrue until the date the Department receives your late tax return and payment. When filling in the "estimated date the return and payment will be received" field in the calculator, please allow sufficient time for the Department to receive the return and payment. If you are mailing a return and payment or giving them to a private delivery service which qualifies under section 7502 of the Internal Revenue Code, the exact amount of late filing/late payment penalties and interest owed will be based on the date they are actually received by the Department, not the date they are postmarked or given for delivery to the qualifying private delivery service. If you are filing a return/making a payment electronically, the exact amount of late filing/late payment penalties and interest owed will be based on the date the accepted return and payment were transmitted.
Please be aware that you may receive a bill for additional late filing/late payment penalties and interest owed if the date you specify in this calculator is earlier than the date on which the Department receives your late return and payment. Also, please be aware that this calculator only computes penalties for late filing and late payment. Depending upon the facts of your case, additional penalties may be due pursuant to law.
Interest is always due on the underpayment or late payment of tax and is computed at the applicable rate determined pursuant to the New York State Tax Law. It is compounded daily from the due date of the return to the date the tax is paid.
This calculator cannot be used to compute the penalty for underpayment of estimated tax by a corporation (Form CT-222) or the penalty for underpayment of estimated income tax (Form IT-2105.9) by individuals and fiduciaries.
